Terms of Service

These terms are the agreement between you and Wakey for use of the Wakey app and this website. By using Wakey you accept them. If you do not agree, please do not use the app.

1. What Wakey is

Wakey is an alarm and accountability app. It schedules alarms and asks you to complete a “mission” — a small real-world or on-device task — to dismiss them, then tracks your wake-up streak.

2. Wakey is not a medical device, and not a guaranteed alarm

Wakey is a habit and accountability tool. It does not diagnose, treat or prevent any condition and does not give medical advice. Talk to a clinician about sleep problems.

Do not rely on Wakey alone where waking on time is critical. Alarms depend on your device and its operating system. Battery savers, Do Not Disturb, force-stop, silent or focus modes, a powered-off or flat phone, operating-system updates, and permissions you have not granted can all prevent an alarm from sounding. To the fullest extent the law allows, we are not liable for a missed alarm or anything that follows from one. Keep a backup alarm for anything that really matters.

3. Missions and your safety

Some missions ask you to move around, take photographs, or go outside. You are responsible for your own safety. Do not attempt a mission if you are unwell, if you would have to do something unsafe, or where doing it would break the law or intrude on someone else’s privacy. Never interact with the app while driving or operating machinery. Skip or change any mission that is not safe for you — you can change your mission type at any time in the app.

4. Your account

You can use Wakey without an account, with your data staying on your device. If you create one, keep your sign-in details secure and do not share your account. You must be at least 13, or 16 where your local law requires it, to create an account. You are responsible for activity under your account.

5. Acceptable use

Do not use Wakey to break the law; do not upload content that is illegal, or that depicts or invades the privacy of another person without their consent; do not try to cheat, reverse-engineer, overload, scrape or bypass the verification system; and do not resell or redistribute the app. We may suspend or terminate accounts that do these things.

6. Subscriptions, trials and refunds

Wakey Premium is a recurring subscription sold as an in-app purchase through the App Store or Google Play. Prices are shown in the app before you buy, in your local currency.

We may change prices for future billing periods. Where required, we will give you notice and a chance to cancel first.

7. Automated verification

Photo missions are judged automatically and imperfectly. A correct attempt may occasionally fail, and Wakey may accept an attempt it should not. Verification results, streaks and achievements are provided as-is and carry no real-world value. We may correct or reset records affected by a bug or by deliberate manipulation.

8. Availability

Core alarm functionality is designed to work offline on your device. Cloud sync, account features and photo verification require a network connection and may be unavailable during maintenance or outages. We may change, suspend or discontinue features.

9. Intellectual property

We own the app, its name, logo and content. You get a personal, non-exclusive, non-transferable, revocable licence to use Wakey on devices you own or control, for personal, non-commercial use. You keep ownership of the content you create; you grant us only the licence needed to operate the service for you — for photo missions, that is a transient licence to transmit and analyse the image in order to return a verdict.

10. Disclaimers and liability

To the fullest extent permitted by law, Wakey is provided “as is” and “as available”, without warranties of any kind, and we exclude liability for indirect or consequential loss, lost profits, lost data, or missed obligations arising from a missed alarm. Where liability cannot be excluded, our total liability to you is limited to the greater of the amount you paid us in the twelve months before the claim, or GBP 50.

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law. If you are a consumer, you keep all mandatory rights your local law gives you, and nothing here overrides them.

11. Termination

You can stop using Wakey at any time and delete your account in Settings or via this page. We may suspend or end your access if you breach these terms or if we discontinue the service.

12. Changes to these terms

We may update these terms. The date at the top of this page shows when. Material changes will be notified in the app, and continuing to use Wakey after they take effect means you accept them.

13. Governing law

These terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction. If you are a consumer resident elsewhere, you may also bring proceedings in your country of residence and benefit from its mandatory consumer protections.

14. Apple-specific terms

If you obtained Wakey from the App Store: this agreement is between you and us, not Apple; Apple has no obligation to provide support or maintenance; Apple is not responsible for any product warranty or for addressing any claim relating to the app; and Apple and its subsidiaries are third-party beneficiaries of this agreement and may enforce it against you.
